By ordering the HELLSMACK Challenge tender, you accept this Waiver and Release of Liability. You understand and voluntarily assume all risks associated with consuming an extremely spicy product. The HELLSMACK tender may cause serious discomfort, including sweating, burning, stomach upset, and may result in bodily injury, property damage, emotional distress, or even death. By proceeding, you agree to release, indemnify, and hold harmless Smackbird LLC and its licensees, affiliates, members, managers, employees, agents, and representatives from any and all losses, claims, demands, liabilities, causes of action, or expenses—known or unknown—arising from your consumption of the HELLSMACK tender. All participants must accept this Waiver and Release of Liability. By placing this order, you certify that you are 18 years of age or older and legally able to accept the HELLSMACK waiver.
